Use the right document for the right problem

A termination notice, rent-demand document, lease addendum and security-deposit statement do different jobs. First identify the state, tenancy type, lease language, reason for the document and required delivery date. Then use the matching guide below. Keep a signed or dated copy and proof of delivery in the tenant file.

Five checks before sending any notice

  1. Confirm the tenancy. Read the signed lease and determine whether it is fixed-term, month-to-month, at will or another arrangement.
  2. Confirm the state and locality. Missouri and Kansas rules are not interchangeable, and local or subsidized-housing requirements may add steps.
  3. Choose the correct purpose. A no-cause periodic-tenancy termination is not the same as a rent demand, breach notice or eviction filing.
  4. Calculate conservatively. Work backward from the intended termination date and allow time for delivery, weekends, holidays and any lease-specific requirements.
  5. Preserve proof. Save the final signed notice, delivery method, delivery date, correspondence and any attorney instructions.
